1.1A bill for an act relating to state government;
designating English as the official language;
proposing coding for new law in Minnesota Statutes, chapter 1.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. [1.55]
OFFICIAL STATE LANGUAGE.
Subdivision 1.
Designation.
English is the official language of the state of
Minnesota. English is designated as the language for use by the state and
local governments, for government officers and employees acting in the
scope of their employment, and for government documents and records.
Subd. 2.
Exceptions.
This section does not apply:
(1) to instruction in
foreign language courses;
(2) to instruction designed
to aid students with limited English in a timely transition and
integration into the general educational system;
(3) to the promotion of
international commerce, tourism, and sporting events;
(4) when determined to
interfere with needs of the justice system;
(5) when the public safety,
health, or emergency services require the use of other languages; provided
that any authorization for the use of languages other than English in
printing informational materials or publications for general distribution
must be approved in a public proceeding by the governing board or
authority of the relevant state or local government entity and the
decision recorded in publicly available minutes; and
(6) when expert testimony
or witnesses may require a language other than English; provided that for
purposes of deliberation, decision making, or record keeping, the official
version of the testimony or commentary must be the officially translated
English-language version.
Subd. 3.
Costs.
All costs related to the preparation, translation, printing, and recording
of documents, records, brochures, pamphlets, flyers, or other
informational materials in languages other than English resulting from an
exception in subdivision 2 must be delineated as a separate budget line
item in the agency, departmental, or office budget.
Subd. 4.
Employment.
No person may be denied employment with the state or
with any political subdivision of the state based solely upon that
person's lack of facility in a foreign language, except when related to
bona fide job needs reflected in the exceptions in subdivision 2.
Subd. 5.
Construction.
This section must not be construed in any way to
infringe on the rights of citizens under the Minnesota Constitution or the
United States Constitution in the use of language in activities or
functions conducted solely in the private sector. No agency or officer of
the state or of any political subdivision of the state may place any
restrictions or requirements regarding language usage for businesses
operating in the private sector other than in official documents, forms,
submissions, or other communications directed to government agencies and
officers, which must be in English as required by this section.
Subd. 6.
Right of action.
Any citizen of the state has standing to bring an action
against the state to enforce this section. The district court has
jurisdiction to hear and decide actions brought under this section.

Article 1. [1.55]
LANGUE OFFICIELLE DE L'ÉTAT
Subdivision 1
Désignation
L'anglais est la langue officielle de l'État du
Minnesota. L'anglais est désigné comme la langue d'usage de l'État et des
administrations locales, des fonctionnaires du gouvernement et des
employés agissant dans le cadre de leur emploi ainsi que la langue des
documents et registres du gouvernement.
Subdivision 2
Exemptions
Le présent paragraphe ne s'applique pas :
(1) à l'instruction dans
des cours de langues;
(2) à l'instruction
conçue pour aider les étudiants ayant des connaissances limitées en
anglais à assurer une transition et une intégration adéquate dans le
système d'éducation général;
(3) à la promotion du
commerce international, du tourisme et des événements sportifs;
(4) lorsqu'il est prévu
qu'il y a interférence avec les nécessités du système judiciaire;
(5) lorsque la sécurité
publique, la santé ou les services d'urgence exigent l'usage d'autres
langues; à la condition qu'une autorisation pour l'usage d'une autre
langue que l'anglais dans l'impression de documents d'information ou de
publications pour distribution générale soit approuvée par une procédure
publique en passant par le conseil de direction, une autorité appropriée
de l'État ou une entité de l'administration locale, et que la décision
soit consignée dans des procès-verbaux disponibles au public; et
(6) lorsque le témoignage d'expert ou de témoins peut exiger
une autre langue que l'anglais; à la condition que, pour les fins de la
délibération, du processus décisionnel ou la maintenance des registres, la
version officielle du témoignage ou des commentaires soit la version en
anglais officiellement traduite.
Subdivision 3
Frais
Tous les frais liées à la préparation, la traduction,
l'impression et l'enregistrement des documents, registres, brochures,
fascicules, prospectus ou tout autre document d'information dans une autre
langue que l'anglais résultant d'une exemption prévue à la subdivision 2
doivent être considérés comme un éléments distinct du budget de l'agence,
du département ou du bureau.
Subdivision 4
Emploi
Nul ne sera privé d'un emploi avec l'État
ou avec toute subdivision politique de l'État seulement sur la base d'une
absence d'habileté à connaître une langue étrangère, sauf lorsque c'est
nécessaire pour effectuer un travail consciencieux, tel qu'il est précisé
dans les exemptions prévues à la subdivision 2.
Subdivision 5
Interprétation
Le présent paragraphe ne doit pas être interprété de
façon à violer les droits des citoyens, en vertu de la Constitution du
Minnesota ou de celle des États-Unis, dans leur usage linguistique lors
de leurs activités ou fonctions exercées seulement dans le secteur privé. Aucune
agence ou aucun employé de l'État ne peut imposer des restrictions ou des
exigences quant à l'usage de la langue pour les affaires du secteur privé,
sauf dans les documents officiels, les formulaires, les soumissions ou
autres communications adressées aux agences gouvernementales et aux employés;
ces documents seront en anglais, comme il est exigé dans le présent
paragraphe.
Subdivision 6
Droit de poursuite
Tout citoyen de l'État a la possibilité d'intenter
une poursuite contre l'État pour mettre en application le présent
paragraphe. Le cour de district a la juridiction pour entendre et décider
de toute cause apportée en vertu du présent paragraphe.
